By enrolling in the CrewHero Affiliate Program ("Program"), you ("Affiliate") agree to abide by the following Terms and Conditions ("Agreement") set forth by CrewHero Inc. ("CrewHero", "we", "our", or "us"). Please read them carefully. Participation in the Program indicates your full acceptance of this Agreement.

1. Program Overview

CrewHero's Affiliate Program allows approved affiliates to promote CrewHero software and earn commissions on eligible referrals. Affiliates are provided with a unique tracking link via PromoteKit.

2. Eligibility

To join the Program, you must:

Be at least 18 years old.
Submit a complete and accurate application.
Maintain an active, publicly accessible online presence or referral network.

CrewHero reserves the right to approve or reject any application for any reason.

3. Commissions

Affiliates will earn a commission on qualifying referrals based on the current commission structure available on the CrewHero PromoteKit dashboard. A "qualifying referral" is defined as a new customer who:

Uses your unique referral link to sign up.
Remains a paying customer past any applicable trial or refund period.
Has not previously engaged with CrewHero through another channel.

Commission payments will be made [monthly/quarterly] through PromoteKit, subject to a minimum payout threshold.

4. Prohibited Conduct

You agree NOT to:

Misrepresent CrewHero or make false claims about the software.
Use spam, paid traffic, or misleading advertising tactics to generate referrals.
Bid on CrewHero-branded terms in search engines without prior approval.
Promote CrewHero in a way that is unlawful, offensive, misleading, or harms CrewHero's reputation.

Violation of this section may result in immediate termination and forfeiture of unpaid commissions.

5. Termination and Suspension

CrewHero may modify, suspend, or terminate your participation in the Program at any time, with or without cause or notice. Grounds for termination include, but are not limited to:

Breach of this Agreement.
Inactivity or low-quality referrals.
Misrepresentation of the CrewHero brand.

Upon termination: • You must cease all promotion of CrewHero. • Access to your affiliate dashboard will be revoked. • Any unpaid commissions may be forfeited at CrewHero's sole discretion if the termination was due to a breach.

6. Program Modifications

CrewHero reserves the right to modify this Agreement or the Program (including commission rates and payment terms) at any time. Continued participation in the Program after changes become effective constitutes acceptance of those changes.

7. Limitation of Liability

CrewHero will not be liable for indirect, incidental, special, or consequential damages, even if informed of the possibility of such damages. Our aggregate liability arising under this Agreement shall not exceed the total commissions paid to you in the 3-month period preceding the claim.

8. Independent Contractor Status

Affiliates are independent contractors. Nothing in this Agreement shall create any partnership, joint venture, employment, or agency relationship between you and CrewHero.

9. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of the State of New Hampshire, without regard to its conflict of laws principles.

10. Miscellaneous

This Agreement constitutes the entire agreement between you and CrewHero with respect to the Affiliate Program.
If any provision is held invalid, the remaining provisions shall remain in full force and effect.
You may not assign this Agreement without CrewHero's prior written consent.
